Trieste. March 29th, 2014. – The Movimento Trieste Libera (Free Trieste Movement) has filled a criminal complain directed to both Italian and International defense authorities, reporting abuses – which seem to be systematic – as for Italy subtracting children to their families as well as subjecting to “amministrazione di sosterno” (from now on: supporting administration) of adults facing difficulties. The report, which has no precedents, analyses this issue in several pages filled with both a judiciary analysis and factual references, as well as denouncing a concentration of such abuses described as “abnormal” involving both categories of vulnerable subjects when it comes to Trieste.
According to the report, in Italy, foster care and supporting administration are disposed by a Giudice Tutelare (Justice in charge of supervising guardianship related cases, from now on: guardianship justice) with an ordinary decree, at their own discretion, without granting any legal defense to the person involved of to their family, also, it seems that a huge number of “supporting administrations” are assigned not to the gratuity of family care, but to lawyers, and also depriving the person of the right to manage their properties, give their consent to medical treatment and to receive correspondence.
This would mean the violation of fundamental and constitutional rights of persons and family, caused by mostly unjustified measures which would cause severe sufferance (even leading to suicide) as well as fueling two “trades” defined as “anomalous”, the first one being related to the high costs of foster care, which the City Council provides for each child under care, the other one concerning economical transitions involving the belongings and estates of the persons under administration.
This is why both “anomalous trades”, which would amount to hundreds of millions Euro, result as being covered by the malicious silence of the powerful categories involved in this scandal, also, Trieste alone seems to have 40% of the national total of assignation of minors to the circuit of “shelter homes” (data provided by the ISTAT) and more than 4000 “supporting administrations” – more then half of these being given in charge to lawyers.
The Movimento Trieste Libera has also sent their report to the European and International authorities, aware that Italian laws cannot be applied to Trieste, since according to specific international instruments (The Treaty of Peace of Paris of 1947 and the Memorandum of Understanding of London of 1954) the Free Port-City still is under trusteeship administration of the Italian Government – not of the Italian State.
